Terms of service

Last updated: October 2, 2026

1. Who we are

This website, www.nicolettaoficial.com (the "Site"), is operated by Nicole María Sutcliffe Quevedo, an individual doing business (persona física con actividad empresarial) under the trade name NICOLETTA® ("NICOLETTA," "we," "us"). Address: Lincoln House, Luis G. Urbina No. 74, Local M, Col. Polanco III Sección, Alcaldía Miguel Hidalgo, C.P. 11560, Mexico City, Mexico. Email: info@nicolettaoficial.com. Phone / WhatsApp: +52 55 4568 0792.

2. Acceptance

By using the Site or placing an order, you accept these Terms, our Privacy Notice, Shipping Policy and Returns & Exchanges Policy, which form part of these Terms. If you do not agree, please do not use the Site. You must be at least 18 years old, or of legal age where you live, to place an order.

3. Products and craftsmanship

Our garments are designed in Mexico and made in small batches, many with permanent pleating and artisan techniques. Slight variations in pleat, texture, color and finish are part of the design and are not defects. Colors may look different depending on your screen. Measurements in our Size Guide are approximate. Please follow the care instructions on each label; damage from improper care is not covered.

4. Prices and payment

Prices are shown in Mexican pesos (MXN) for customers in Mexico and in U.S. dollars (USD) for customers outside Mexico, based on the shipping country. You are charged in the currency shown at checkout, and that is the amount of your order. MXN prices include IVA. International prices include import duties and taxes, which NICOLETTA prepays (see our Shipping Policy). USD prices may change over time with exchange rates; the price shown when you place your order is final for that order. Refunds are issued in the same currency as the original charge, for the amount you paid; we are not responsible for exchange-rate differences or fees charged by your bank. Shipping costs are shown at checkout. Payment is processed by Shopify and its payment partners; we never see or store your full card details.

5. Orders and acceptance

Your order is an offer to buy. A contract is formed when we send the shipping confirmation email. We may decline or cancel an order, in whole or in part, if: the item is out of stock; there is an obvious error in price or description; we suspect fraud or unauthorized payment; or the order appears to be for resale. If we cancel after you have paid, we refund you in full to the original payment method.

6. Pricing and description errors

We work to keep information accurate. If a product is listed at an obviously incorrect price or with a material error, we will contact you before shipping, and you may confirm at the correct price or cancel for a full refund.

7. Pre-orders and made-to-order pieces

Pre-order items are charged at purchase. The estimated production time is shown on the product page (generally 10 to 60 business days). If production is delayed beyond the stated estimate, we will notify you and you may choose to wait or cancel for a full refund.

8. Shipping, returns and exchanges

Delivery and returns are governed by our Shipping Policy and Returns & Exchanges Policy. Title and risk of loss pass to you when the carrier delivers the order to the shipping address you provided.

9. Your consumer rights

Nothing in these Terms limits the rights you have under the Ley Federal de Protección al Consumidor (LFPC), including your right to cancel an online purchase within 5 business days of delivery (Art. 56) and your rights for defective products. You may contact the Procuraduría Federal del Consumidor (Profeco) at any time. Customers outside Mexico keep any mandatory rights granted by the consumer laws of their country.

10. Intellectual property

NICOLETTA® is a registered trademark in Mexico (IMPI Reg. Nos. 3103137, 3103138 and 3103139). SUTCLIFFE NICOLETTA™ is our trademark in the United States and other countries. All designs, patterns, garment construction, photographs, videos, texts, logos and graphics on the Site belong to Nicole María Sutcliffe Quevedo or are used under license. You may not copy, reproduce, modify, distribute or use them for commercial purposes, including to manufacture or sell copies of our designs, without our prior written permission. Sharing our posts with credit for personal, non-commercial use is welcome.

11. Acceptable use

You agree not to: use the Site for any unlawful purpose; attempt to access our systems or other customers' data; introduce viruses or malicious code; scrape or copy Site content; or place fraudulent orders. We may suspend access for anyone who breaches these Terms.

12. Chargebacks

If you have a problem with an order, please contact us first so we can resolve it. You agree that the carrier's delivery confirmation to the address you provided is valid proof of delivery. If you file a chargeback claiming an order was not received when tracking shows it as delivered, or claiming an item was not as described without following our returns process, we will dispute it with the card issuer using the order record, your acceptance of these Terms at checkout, carrier tracking and delivery confirmation, and our correspondence with you. We may decline future orders from customers who file chargebacks that are resolved in our favor.

13. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, or for delays caused by carriers, customs, natural disasters or other events beyond our reasonable control. This clause does not exclude liability that cannot be excluded under Mexican law, including your rights under the LFPC.

14. Third-party links and services

The Site may link to Instagram, Pinterest, payment providers and other third-party services. We are not responsible for their content or privacy practices.

15. Changes to these Terms

We may update these Terms. The version published on the Site at the time you place your order applies to that order.

16. Governing law and jurisdiction

These Terms are governed by the federal laws of Mexico. Any dispute will be submitted to the competent courts of Mexico City, and you waive any other jurisdiction that may apply because of your present or future domicile. This does not prevent you from filing a complaint with Profeco.
